Does that mean this memo has nothing to do with Legal Employment based 485 approvals?

Lol no I'm relaxed enough...just worked up about the rally. I am attending and did contribute too. Am meeting some others later to put up more flyers. All this did was get me more psyched...no harm done :)
Well, IV needs more like you. :)
Meet you in DC. I will be at the IL chapter area.

Please do not try to thwart the campaign. We are trying to address a specific issue, which is about blocking approvals when dates are current, and for that, we are using this current fiasco as an example. The USCIS memo specifically talks about EB2 india, china applicants on hold. Since EB3 was listed as U, we cannot do anything about it. If both EB2 and EB3 were current, I would have given a call to both. There is no belittling out here. the Circumstances are like that.
EB2 and EB3 are working together in the visa re-cpature.
This is a separate issue, but will be useful when visa re-capture is successful.
history has proved that faxes and e-mails have helped. So, please act in the remaining 20 days

EB3 Guys,
Take it easy... This is just for humour, to have fun at these times.
No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. After 6 years, get nice job in India, own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them. Try to become director, AVP,VP,SVP,CEO,CTO and President. Do not go for green card. After you become director, buy a single family home and mercedez or BMW and have fun. Retire by the time your kids become earners. Grow vegetables in back yard. Do gardening and have fun. Thats how life should be. Do not hope for green card. H A V E F U N.
Does it make any sense...in the name of humour you are just pissing every one here.

I sent out an email about IV and this thread to my family and friends today and One of my friend called and said he will make a contribution. so let's see. I have posted about this thread on the Southern California Yahoo groups and sent emails to some IV members I have met recently. so we will see how this turns out. My thought is to keep this thread active throughout the Holidays season. We have 6 weeks to go this year and 23,000 members. Let's see how much we can raise in this time frame.
At one of the booths we had in Southern California a couple of weeks ago a gentleman happened to stop by and said "your orgnization is so strong you can raise funds easily because it only takes every member in your group to contribute 10$ and you will have close to 250k in funds in no time". If it's that easy my dream will definately come true

To those of you'll willing to send this out .. hold on until I post the final version of the letter as it appears to require some editing.
Once again, whats the email of the Ombudsman? I would also like to send this to the USCIS. How do I go about it?

Hey UN
Are you aware of State Deptt URLs that explain current immigration rules (similar to IRS rules) as following.
Someone posted a URL that requires a good choice of search words. Such a process may not get all info specially for a novice like me. Thanks.
From the November 2005 visa bulletin
http://travel.state.gov/visa/frvi/bulletin/bulletin_2712.html
HOW IS THE EMPLOYMENT-BASED PER-COUNTRY LIMIT CALCULATED?
Section 201 of the INA sets an annual minimum Family-sponsored preference limit of 226,000, while the worldwide annual level for Employment-based preference immigrants is at least 140,000. Section 202 sets the per-country limit for preference immigrants at 7% of the total annual Family-sponsored and Employment-based preference limits, i.e. a minimum of 25,620.
The annual per-country limitation of 7% is a cap, meaning visa issuances to any single country may not exceed this figure. This limitation is not a quota to which any particular country is entitled, however. The per-country limitation serves to avoid monopolization of virtually all the visa numbers by applicants from only a few countries.
The AC21 removed the per-country limit in any calendar quarter in which overall applicant demand for Employment-based visa numbers is less than the total of such numbers available.
In recent years, the application of the rules outlined in AC21 has allowed countries such as China mainland born, India, and the Philippines to utilize large amounts of employment numbers which would have otherwise gone unused.
During FY due to anticipated heavy demand, the AC21 provisions are not expected to apply, and the amount of Employment numbers available to any single country will be subject to the 7% cap. It is anticipated that the addition of unused FY-2005 Family numbers and the remaining AC21 numbers to the 140,000 annual minimum will result in an FY-2006 annual Employment limit of 152,000. This will mean an Employment per-country limit for FY-2006 of approximately 10,650.
To illustrate the effect of the reduced per-county limitation during FY-2006 on the oversubscribed countries, it should be noted that during FY-2005 India used approximately 47,175 Employment numbers.

If I am not mistaken, you can start working for a new employer as soon as they apply for a H1 transfer. You have 240 day period, in which it must be approved. You should be ok, assuming that you got the approval within 240 days of July 1st 2004.
Thanks deecha for your response , I am sorry that i was unable to frame the question properly. My question is traing period (July 1st 2004 to Aug 30th 2004 = 60 days) without pay on H1B is treated as Out Of Status??? Is this period(July 1st 2004 to Aug 30th 2004 = 60 days) counted towards 180 Days period (to be covered under 2445(K)) or not?
