If less than 20,000 MS H1B applications were received on April 2, what will be the rules of the lottery? Will all those whose applications were received on April 2 be guaranteed a H1? In this case,will lottery apply for April 3 and April 4?
If an application is received on April 2 and there are enough h1s available then clearly that application wont be subjected to a lottery. Lottery is only applicable to applications received on the same day when there are not enough h1s available.

Its almost cleared till Feb 2004 for EB2. So i am thinking from September 1st 2009, its from March 2004 to December 2004. Not sure how many pending cases are in this time period.

This is best at ppl things narrow minded , since you are EB2 you want to have this.. EB3 can port to EB2 then EB3 will never get spillovers.. and if you have latest PD you might get in to this issue... So prepare now for another admin fix. shouldnt we stop looking at bigger picture and start only on the smaller things like this ? Can you support with numbers how EB2 can get line cleared ? If that is true then there is no need of Recapture... becoz when EB2 goes current all numbers flow to EB3.
As gc_check explained, all EB2 with PD<2007/7 will get the green card 2 years earlier if this can be fixed. I do not understand why IV can not discuss it with USCIS.

What I need to do now? My I-94 has wrong expiration date (I entered in US on 03/07/2007 and I got I-94 with expiration date as 01/10/2007). My attorney told me that it can be explained later. So, I've already file my 485 with a bad I-94.
Please let me know if anything can be done or still I can do something to correct this issue.

USCIS does not give how many Visas they have used and how many are left
like how many unused have gone to EB3 or Eb2 etc
if its Vertical or horizontal visa distribution
they have been some Law Suits on them to give the data

I was hoping the date to be somewhere around March 2005. That would have taken care of all Backlog Elimination Center cases.
- Current dates show that there were a lot of BEC cases to be approved.
- Now, dates might struggle a bit to reach April 2005.
- Dates should move faster after that till end of 2005 as there were very few cases that went through PERM in 2005.
- Again, in 2006 the Dates might move slow till......we reach last FY month overflow in Sept 2010.

I am eligible to file for 485 under the current (July) visa bulletin. My wife is transitioning from L1B(expired in May) to H4(Awaiting receipt) and is therefore out of status. I am wondering if she should apply with me (claiming that her status is H4) or should she wait till she gets her H4 (which could be in August).
My questions are:
1. Is it necessary that one's spouse should apply concurrently?
2. Can one's spouse (H4) apply for 485 as a follow up to her husband's application in July even if the visa numbers are not available (i.e in August when the visa bulletin says Unavailable)?
please help.
