Since many gurus are of the opinion of not going the legal way, here is what i think is the best.
1. try to create awareness of her wrong-doing on social sites. Put the video, (if you like) on the sites.
2. Put a comment on the sulekha ad itself for this nanny (i dont know if you can do this).
3. Put comments on City search site. citysearch.com
4. Scare that woman away saying that you have found out that she is hitting the baby and you can complain to the cops.
this way we can make sure nobody else is hiring her as nanny.

Everybody's case is different, when it comes to how they feel being a in a foreign country and hanging by a thread to get a stable status and stable life. You seem to have gotten a stable job which probably means you are better than most of the people who are working as contractors. But what matters is being on Visa, are you able to enjoy your life here? Will getting a GC help you have a better life or will you continue to lead the same life?
I think if you believe getting a GC will help you lead a better life you should stay here - since your i140 is cleared its another 4-5 yrs wait max. On the other hand if your job here is unstable and you think you will have a better life back home, then you should move. Bangalore is a great city as long as you have a comfortable job and good pay.
Thanks man. My decision was mainly based on the waiting period. Within 4-5 years I can get ultimate post based on my experiance at india but here I have to be in same role.
Also I am trying to start my own IT training firm there so with gods on my side in 4-5 years that company can grow to a mid size firm.

I like srikondoji's idea. Infact I had pitched it to Pappu in a pm couple of weeks ago. Lets create a list of members who wish to sign up for bi-monthly contribution by say Dec 31st and publish that list. The first of the bi-monthly contribution from members of the list is due no later than Jan 31st 2007. I am ok with the $25 bi-monthly figure. Sign me up!

I decided to move to india now. I have I140 cleared and having a permanent job. But enough is enough!
I started looking openings at india 2 weeks ago and most probably will get a offer from a US financial giant having IT shop at bangalore.
I think this is right decision at this time.

On the same note I have a question for the Gurus.
My name is reversed ( first name and last name interchanged) on my SSN and hence on my credit cards, employment letters etc though my name is correct on my passport , H1 , I-797 and on files AOS.. etc.
Will this pose a problem in the name check process?
My attorney said I should change my name with SSN after EAD/AP arrives.
Let me know ur opinions.

The aim of this appeal is not to compare or compete with EB1, PhDs, US MS degree holders or discuss other exotic bills!
There are several hundred EB2 / EB3 folks who have continued to live here for several years (many have crossed 10 years). They are stuck in the infinitely long GC line, for no fault of theirs. It is natural that people who have stayed for long have grown up children (who are not US born) and who need to go to a good college for a good future.
It is almost impossible to pay international fees and it is neither fair no appropriate to break the back of genuine law abiding residents, despite the fact that they have lived for
8 / 10 years and have sincerely paid the taxes due to the government, just because they do not have a GC.
For the "sin" of being Indian/ Chinese born and for the "sin" of not being able to get the GC because the rules favour long term indentured labour, an entire upcoming yonger generation should not be allowed to suffer. This is unfair and discriminatory. If any one of us had been from a country other than India and China, we would have obtained out GCs in 3 / 4 years.
The idea is to have the cases of all genuine, hard working, EB2 / EB3 employees who have honestly lived here and are continuing to process the path ot GC legally, be considered from the human angle, more so from the point of view of the education of the children.
When it comes to illegals, people scream about human values, humanitarian considerations, education of their children, family ties etc etc. What about us, who have followed the rules "to the T" ????
Is following the rules, going through the approval complex web of approval processes, paying taxes and trying to lead sedate and simple lives a sin?
Are we not human beings? May be we are labelled "aliens" but we are certainly not from Mars!
So friends, let us be clear in where we stand and what we are pleading for.
Unless we have the conviction and clarity we cannot make any progess!
Long live the unity of EB 2 / EB3 employees!
May the SUPREME POWER bless IV and the genuine forum members!

what do you mean by supporting IV?
If you are talking about financial donations below model works best for me.
lets say IV core comes up with COST of doing X,Y, Z fixes within XX weeks.
COST is shared among wishing to donate. This becomes like a product purchase.
Current model is not time bound nor result oriented.
Again I am not anti-IV or anything. I am just expressing my idea!

Thunderbold, Sorry for your situation. Here is my observation/suggestion.
Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?
You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.
This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.
This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?
What are we going to do with that money man? This is nothing but a greediness.
Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.

I am not the prototypical IV member in that I have only been on the H1-B visa since 6 months after graduating with my masters .. my company hasn't even started the GC process yet. So my interest in legal immigration reform is more from the perspective of someone who will enter the GC pipeline in the near future rather than one currently stuck in the BEC/retro mess.
I began working for my current company (a high-tech start-up) as an intern when I was still a student .. my work on a prototype VoIP solution for cellphones helped the company win a second round of venture funding .. and needless to say, created lots of jobs through company expansion. I am currently very well placed in my company and seem set for a good future with them.
However, seeing the plight of other, more senior talented EB folks here stuck in limbo, i am seriously re-considering my options .. I think its better to switch to a plan B now, rather than invest several years of time and emotional effort in my career here only for me to be stuck in legal and professional limbo. I have already applied for canadian permanent residency, and if the status quo continues, I will have little hesitation in moving there, to a company in my area of expertise. I assure you that several of my classmates are in the same boat as me. If the GC system is not fixed anytime soon, I am fairly sure the retro issue will disappear by itself in few years time .. coz there will be no more applicants left to be enticed by this american mirage.

I was confused because of this statement which is stating 60 days only -

One more thing I'm sorry. Last April(last entry date) when I came back after vacation, I transferred to a new company, after I got the receipt number they asked me to start working (that was around April too). Until now, I haven't received any approval yet. What should I enter in my present employer details, my old company or new company (wherein my transfer is still in process)?
